Ethics for Law Firm Title Companies: Avoiding Malpractice and Negligence

Event Description

Pennsylvania is one of many states that allow non-attorneys to handle real estate closings, meaning that holding a real estate closing is not, by itself, considered the practice of law. Pennsylvania case law recognizes a claim in tort for negligence for a title company’s failure to discover and disclose a defect, lien, or encumbrance on title in a title commitment or succeeding policy. Additionally, when a law firm’s title company handles a closing, it may be subject to a malpractice suit by any party to the closing that believes it was a client of the firm. The purpose of this CLE is to explain Pennsylvania case law relative to negligence actions which may be brought against title companies, including law firms, and practice pointers relating to mitigating this risk.
