How Environmental Requirements Can Wreck the Land Development Process

Description: This presentation will provide an overview of Pennsylvania environmental statutes, regulations, and policies that impact the land development process. It will include a discussion of the Sewage Facilities Act, stormwater permitting, wetlands encroachment, and Pennsylvania’s Environmental Rights Amendment. The presentation will also address the roles of the Department of Environmental Protection, the Environmental Hearing Board, and county conservation districts.

Description: This panel will discuss approaches to addressing public scrutiny and opposition to a client’s development project that requires approval from a municipal body or state agency. Key discussion items will include suggestions and war stories on responding to public comments and presenting the project in public forums or hearings.

Siegel
Martin R. Siegel, Esquire
Of Counsel, Barley Snyder LLP

Mr. Siegel is a member of Barley Snyder’s Real Estate and Environment & Energy practice groups who spent more than two decades as a litigator at the Pennsylvania Department of Environmental Protection. In his time at the DEP, he litigated more than 250 appeals in state and federal courts and in front of the Pennsylvania Environmental Hearing Board in cases involving litigation of solid waste, clean water, environmental remediation and sewage planning. In the private sector, Mr. Siegel has worked with businesses on both environmental and energy issues. He’s helped companies in real estate transactions navigate environmental issues, worked with municipalities on stormwater and sewage issues and has assisted companies and other entities in addressing DEP and U.S. Environmental Protection Agency enforcement actions. In addition to his time at the DEP, Mr. Siegel has worked in federal government positions at the U.S. Centers for Disease Control and Prevention and the Agency for Toxic Substances and Disease Registry in Atlanta and with the Department of Energy’s Pacific Northwest Laboratory in Washington state. He has a J.D. from Temple University, B.A. from the University of Pennsylvania, and a M.P.H. from the Johns Hopkins Bloomberg School of Public Health and Hygiene.


Josele Cleary, Esquire

Ms. Cleary is a shareholder in the Lancaster law firm of Morgan, Hallgren, Crosswell & Kane, P.C. Her practice is concentrated in land use and municipal law and she represents municipalities, zoning hearing boards, authorities, developers and citizens’ groups. Ms. Cleary is the Editor of the Pennsylvania Bar Association Municipal Law Section Newsletter and prepares the New Case Summary for each edition. She has been an author, lecturer and course planner for the Pennsylvania Bar Institute. She received her B.A. from the Pennsylvania State University and her J.D. from the University of Pennsylvania. Ms. Cleary is a member of the Lancaster County and Pennsylvania Bar Associations.

Neil L. Albert, Esquire

Neil came to Lancaster when he graduated from Villanova in 1976 to clerk for Paul Mueller. At the end of his clerkship he went to work with the firm that eventually became Zimmerman, Pfannebecker, Nuffort & Albert. About a third of his time was municipal and zoning work. He argued municipal and zoning issues a number of times in Commonwealth Court.  The balance of his practice was litigation--civil, criminal, and family law. In 2020 he left the firm and started a solo practice limited to municipal and zoning law--three months before Covid hit. He is special counsel for the City of Lancaster, Solicitor for Denver Borough, and serves as solicitor to seven zoning hearing boards.

Reilly S. Noetzel, Esquire

Reilly Noetzel is a member of the Barley Snyder’s Real Estate Practice Group and the Construction, Environment & Energy and Municipal industry groups in addition to being a licensed title agent. He dedicates his practice to the representation of clients in all aspects of their real estate transactions and developments with a particular focus on land use and development, construction and regulatory matters as well as leasing. He has a deep understanding of the Municipalities Planning Code and the requirements that municipalities and developers must follow throughout the land development process in Pennsylvania. Reilly’s experience in this area includes assistance with the development of mixed-use, commercial / industrial buildings and complexes as well as residential neighborhoods. In addition, Reilly frequently counsels clients on the Pennsylvania Uniform Planned Community Act and Uniform Condominium Act. He prepares homeowners’ association and condominium documents for developments of all types and sizes, including building conversions, shopping centers, residential planned communities, master-planned developments, and site condominiums.

Robert "Bobby" J. Schena, Esquire
Partner at Fox Rothschild

Bobby is a partner in the environmental practice group at Fox Rothschild.  His practice includes permitting, compliance, and litigation, especially as to agriculture, mining, industrial wastewater permits, stormwater, sewage, and all things PFAS.   Prior to starting at Fox in 2019, Bobby spent six years at the Pennsylvania Department of Environmental Protection, where he primarily advised the Department’s Act 537, waste, storage tank, and environmental cleanups programs as to permitting, compliance, litigation, and policy and regulatory developments.
